Reading a Spanish tender, and the language of the BOE
Spanish administrative and legal language has a reputation, even among Spaniards, for being opaque. The style descends from the language of laws and decrees published in the Boletín Oficial del Estado, the BOE, and in the provincial and regional bulletins, and it has features a learner can name once and then recognize everywhere. The future tense obliges, as Íñigo explains: el adjudicatario presentará is a command. The absolute participle compresses time: presentada la documentación, publicada la resolución, transcurrido el plazo. Formal prepositions replace ordinary ones: en virtud de, a efectos de, conforme a, al amparo de. Abstract nouns replace verbs, as in lesson 114. And cross-references abound: lo dispuesto en el artículo, en los términos previstos en el apartado. None of this is decoration. It is designed to be precise and to be quoted in a dispute, and it is the register in which rights and obligations are actually set out. A consultant who can read it quickly has an edge, because the parts that matter for winning, what is compulsory, what is scored and how, are buried in it. Two phrases are worth finding first in any pliego: requisito indispensable, which excludes you if you do not meet it, and se valorará, which earns points if you do. There has been real effort to clarify it. Plain-language initiatives in public administration and the courts encourage shorter sentences and ordinary words in documents addressed to citizens. Tender documents, written for companies and lawyers, have changed less. Most Spanish offices therefore have an Elena, someone who reads the BOE without flinching, and everyone else relies on her and on colleagues like Íñigo who translate it into Spanish at the coffee machine.
