Lavoro agile, and the right to switch off
The policy being written in this room sits on top of a real statute. Italy legislated for lavoro agile in 2017, before the pandemic made it ordinary, and the law has two features worth knowing. It requires an individual written agreement between employer and employee rather than a blanket company rule — which is why Serra cannot simply announce a number — and it obliges that agreement to specify rest periods and the measures ensuring disconnection from the equipment. Il diritto alla disconnessione is therefore not a courtesy Nadia is asking for but a thing the document is supposed to contain. The term itself is the better-known curiosity. Smart working is an Italian coinage in English clothes, now so established that the legal term lavoro agile sounds like a translation of it rather than the other way round. Note also what the conversation does not contain: any suggestion that monitoring software would settle the question. Italian workplace law restricts remote surveillance of employees quite sharply, and both the unions from Lesson 73 and the privacy regulator take an interest — which is why Serra's niente software is a statement of fact as much as of preference, and why Alex's six-month sperimentazione is the move that gets the policy written at all.
