What a German tenancy gives you, and the protocol nobody should skip
German tenancy law is among the most tenant-friendly in Europe, and the practical consequence is that most of your protection does not depend on the contract being generous. The deposit is capped at three months' Kaltmeite, may be paid in three instalments, and must be held separately from the landlord's own money. Notice is asymmetrical, as the grammar note explains: three months from you, longer and for a reason from them. The reason usually cited is Eigenbedarf, the landlord needing the flat for themselves or close family, and it is a genuine ground but a narrow one that has to be substantiated. The Nebenkostenabrechnung has its own rules. The landlord must produce it within twelve months of the end of the accounting period, and a demand that arrives later than that is generally unenforceable. You are entitled to see the underlying invoices. A refund is as likely as a demand, and the commonest error in the statement is charging a tenant for something that is not an allowable operating cost — repairs, for instance, as opposed to maintenance. Two clauses to look for before signing. A Staffelmiete fixes increases in advance, which can be good or bad but at least is knowable; an Indexmiete ties the rent to inflation. And Schönheitsreparaturen clauses — requiring you to redecorate on leaving — have been struck down by the courts so often, in so many wordings, that many are simply void. If yours obliges you to paint on a fixed schedule or to leave the walls white, it is worth having checked rather than obeyed. Finally, the thing that costs more tenants their deposit than anything else: the Wohnungsübergabeprotokoll. At handover, walk the flat with the landlord and write down every existing mark, scratch and defect, photograph everything, and both sign it. Do it on the way in and again on the way out. Without that document, the state of the flat on the day you arrived is a matter of recollection, and recollection favours whoever is holding your 2,850 euros.
